Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Fortfolio website, applications and related services (together, the “Service”). By accessing the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Educational purpose only

Fortfolio is provided strictly for educational and informational purposes. Nothing on the Service constitutes investment, legal, tax or other professional advice, and nothing on the Service should be interpreted as a recommendation to buy, sell or hold any security. We are not a registered investment adviser, broker-dealer, or research analyst. Always consult a qualified financial adviser licensed in your jurisdiction before making investment decisions. Full risk language is on the Disclaimer page and forms part of these Terms by reference.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. Account creation is optional; most features work without an account. If you do create an account, you are responsible for the security of the credentials used by your identity provider (we use Google OAuth) and for any activity that occurs under your account.

3. Acceptable use

You agree not to:

  • scrape, mass-download, mirror or otherwise copy the Service except as needed for normal personal use;
  • reverse-engineer or attempt to derive the source code of any non-open-source component;
  • use the Service to impersonate any person or entity, or to misrepresent your affiliation;
  • interfere with or disrupt the Service or the servers and networks that host it;
  • upload or transmit content that is unlawful, harassing, defamatory or infringing;
  • use the Service to provide investment advice to third parties for compensation without complying with the regulations that would apply to such activity in your jurisdiction;
  • use automated tools (bots, scrapers, headless browsers) against the Service at a rate that imposes load disproportionate to a single human user.

4. Intellectual property

The Service, including the underlying software, user interface, copy and design system, is owned by Fortfolio or its licensors and is protected by copyright, trademark and other laws. We grant you a personal, non- exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purposes. Ticker price data used by the Service is sourced from third-party providers (yfinance, EODHD) and is subject to those providers’ own terms.

User-generated content — portfolios, saved tests, bug reports, feedback — remains yours. By submitting it to us you grant Fortfolio a worldwide, royalty-free licence to host, store, process and display the content as needed to operate the Service and to use de-identified aggregations of it to improve the Service.

5. Third-party services

The Service relies on third parties including but not limited to Google OAuth (authentication), Resend (email delivery), DigitalOcean (infrastructure), Lemon Squeezy (payments), yfinance and EODHD (market data). Their availability is outside our control. Their respective terms and privacy policies govern the data they collect directly from you.

6. Paid plans

Where the Service offers paid plans, the price, billing cadence and feature set in force at the time of purchase apply. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are at our sole discretion except where local law (e.g. EU consumer-rights directive distance-selling rules, Indian Consumer Protection Act) provides otherwise. You can cancel at any time through your account page or by emailing billing@fortfolio.app.

7. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. We make no warranty that the Service will be uninterrupted, error-free, or free of harmful components, nor that any defects will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTFOLIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. Our aggregate liability for any direct damages will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 100.

In particular: Fortfolio is not liable for investment decisions you make based on output of the Service, for losses incurred in actual investing, or for inaccuracies in third-party market data. Historical stress tests are not predictions; output is illustrative of past episodes, not future ones.

8. Indemnification

You agree to indemnify and hold harmless Fortfolio and its affiliates from any claim, loss or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time. The sections of these Terms that by their nature should survive termination — including Sections 4 (IP), 7 (Disclaimers and Liability), 8 (Indemnification), and 10 (Disputes) — will survive.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. For users resident in the European Economic Area, the United Kingdom or India, mandatory consumer-protection rules of your country of residence continue to apply.

Any dispute arising out of or relating to these Terms or the Service will be resolved in the state and federal courts located in Delaware, United States, except that we may seek injunctive relief in any court of competent jurisdiction, and that consumers may bring proceedings in their country of residence as allowed by local law.

11. Changes

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. If a change is material, we will notify you in advance via the email associated with your account or by a notice on the home page for at least 14 days. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
